Back on November 3rd, the article was published about the huge victory for Tony the Truck Stop Tiger.  The Animal Legal Defense Fund (ADLF) in concert with advocates for Tony had succeeded in getting a court decision that the permit to keep Tony imprisoned was unlawfully issued and would be revoked, with no new permits ever being issued.  You can read that story here.

Sadly, the good news has been short-lived.  On November 30th, Tony’s guardian and owner of the Tiger Truck Stop, Michael Sandlin, has filed an appeal of the decision.  Also, the Louisiana Department of Wildlife and Fisheries filed papers regarding the decision that stated they were responsible for the costs.

All of this legal wrangling means that Tony stays right where he is.  This is even in the face of the fact that the current permit expires this month, regardless of the court decision.

Tony is an 11-year-old Siberian-Bengal tiger who has been used as nothing more than an attraction at the truck stop, living in an enclosure where he is taunted by tourists and breathes the gas and diesel fumes constantly.  The fight to free Tony has gone on for years, with roadblocks being thrown up at every turn trying to keep him in this prison.  You can read Tony’s story in detail at the Free Tony the Tiger website linked below.

The youngest advocate in Tony’s campaign, 11-year-old Breawna Smith, visited Tony on November 19th and took several videos.  The video provided here courtesy of Ms. Smith is one she had created called “Tony’s Journey” and includes her narration of a poem she wrote for him.  It’s heartbreaking to see this magnificent animal reduced to this existence. Who knows how long this latest round of legal maneuvers will take, all the while as Tony waits. Even though Judge R. Michael Caldwell agreed that the permit should be revoked, which would have set Tony free, Sandlin simply won’t allow Tony to have that peaceful life.  He wants his “main attraction” to stay, bringing in the customers and of course, the income.

It appears that Tony is caught in the middle of a tug-of-war between what’s right and just, and pure and simple greed.  This magnificent animal is wasting away right before our very eyes, while the slow wheels of bureaucracy grind on.

The petition at Care2 is linked below.  While advocates believed their voices had been heard and Tony was finally to be free, such is not the case and your voices are still needed for Tony.  Please consider adding your voice to this petition for Tony.  (The petitions at Care2 normally allow for anyone from any country to sign.)

Advocates in Tony’s campaign have vowed to never give up.  As his staunchest supporter and Founder of the Free Tony the Tiger campaign, Sky Williamson’s motto says: “Until His Last Breath…” That one statement says it all.

Don’t give up Tony.  Advocates everywhere are fighting for you to finally know the peaceful life you so deserve.

The debate over whether a tiger
can remain as an attraction at a Grosse Tete truck stop has been clawed at for
years. A state judge ruled that the Tiger Truck Stop owner could no longer keep
his tiger, Tony, at the gas station. Michael Sandlin, Tony’s owner, said
thousands have come to marvel at the exotic animal on display at the truck stop.
“We’re from Florida and we were on our way to Texas and it was kind of amazing
to see a big cat here,” said Jody McGahan, a Tiger Truck Stop customer. “He’s
beautiful” “Every American should have the right to own an exotic animal of
their choice if they’re financially and morally capable of taking care of that
animal,” Sandlin said. The Department of Wildlife and Fisheries gave Sandlin a
permit to keep the tiger, but a nonprofit group, the Animal Legal Defense Fund
filed a lawsuit against the agency in a bid to have the cat moved to a more
natural setting.

“They want to yank him
from the only home he’s known for the past 10 years and the people that he’s
known and send him to another cage somewhere where he won’t have that,” Sandlin
said.

The paddock the animal is kept in appears larger than some zoo
exhibits with a grassy area, a tank for the tiger to swim in, toys, shade and an
air conditioned room for Tony. The barred cage is surrounded by a barbed-wire
fence and the truck stop is staffed 24 hours, Sandlin said. Regardless, a judge
will have to decide if the attraction will be allowed to stay. “He’s beautiful.
I would miss him,” McGahan said. Sandlin hasn’t filed an appeal yet, but his
attorney said he plans to do so. The Animal Legal Defense Fund said it will
“continue to do everything we can to make sure Tony’s next home is a reputable,
accredited sanctuary that can give Tony the life he deserves.”

We often hear people say that children possess a certain honest quality which adults often lack. Generally, this is associated with innocence and often, it can be overlooked or dismissed. In some cases however, one finds it difficult to overlook certain qualities in a child that all human adults should aspire to see in themselves. This is no more evident in any case, than that which young Breawna Smith represents.

Rather than attempt to explain to all of you as to why we respect this young lady in the manner that we do, we will allow for these letters, written by Breawna and her mother, Kathy, to speak for themselves. Please read “Silence” by Kathy Smith and “FREE TONY” by Breawna Smith.

Silence by Kathy Smith:


Silence is something my child knows nothing about, something that was not part of her make-up, but silence certainly followed what became a turning point in her life. Silence was the cold eerie, hollowness that followed her visit to a caged tiger in Louisiana. The silence that followed us home that evening remained with us the next day and existed until her resolve was once again restored with a determination to help her friend Tony. It was the silence of an exuberant child after the cold hard facts are realized.

The bond between this child and big cats goes way back, perhaps before birth in some unforeseen heaven, some place where her heart and soul were joined in the animal kingdom and a special gift was given to the world. Not that I, her parent would put her on that type of pedestal, but others have witnessed the insights and events that follow a vision, dream or thought. She has always talked and walked with a different perspective on wild cats. Genuinely concerned with the caging, petting and exploiting of these cats she would rebel at attempted interactions with them until she was old enough to teach us the difference and express her views confidently.

That is what brought us to the whole “Tony Situation” as family and friends refer to it. After learning about the 10 year old tiger in a cage at a truck stop no less, Breawna relentlessly proceeded to involve anyone in her quest to visit Tony and speak to his owner. She was appalled that a big cat would be treated as a roadside attraction for the amusement of passing tourist just like long ago places displayed animals. Her father and I were nonetheless surprised when a planned holiday trip was rebuked in favor of the Tony visit and plans were started. We had previously learned that she would continue on any quest regardless of the obstacles and wanted her to be fully informed and to realize that such a large undertaking as a conversation with Michael may not happen and if it did may not end well on her part.

The trip did require research and Breawna spent days on the computer, all the time not believing that any of the situations could be as bad or true as exposed. Many of her statements reflected that someone could not be treating a tiger that badly. Once she told me that she had been dreaming about Tony and was sad that he could only see out of his chain link prison, she also mentioned on occasion that he was lonely and tired. She insisted that she would video some pieces and be his voice. Her friends at Big Cat Rescue would benefit from those videos once taken. All the points she wanted to cover were written down and she reviewed them often, even with her teacher at school.

Discovering the whole story about Tony and investigating what she could do and how she could effectively be his voice, did not make a difference in her perspective and I was faced with a determined child who would just not let it go. After weeks of begging to go, pressure to let her help, the persistence continued until a trip was finally planned and a life changing journey began.

Breawna designed a “Free Tony” t-shirt with the help of some school friends and commissioned an airbrush artist to make the shirt only one week before the trip.

We left home the day after Thanksgiving 2010; Black Friday took on a new meaning for our family that day. The trip started at 3am with an anticipated arrival to the truck stop off I-10 in Gross Tete around 12 noon. It’s important to note that after a balmy 80 degree day we started westward from Florida in 70 degree temperatures that morning.

Prior to us leaving and during the trip she voiced over and over the thoughts that also concerned me…

· What to do if they tell you to leave? Can I stay by Tony’s cage?

· Will they arrest us for being there talking about how Tony feels?

· What if they touch me or hit me or throw something at us?

· Will they have cameras around too?

Initially she had wanted to set up a mock cage to spend the weekend in; to raise awareness of how Tony felt, but after the research we thought it would be better to do a quick visit.

We traveled with an energized 10 year old that chattered all the way. Traveling with Breawna involves multiple stops due to some joint issues she has, so it was slow going and took longer than expected. Halfway there the temperatures started to drop and rain pounded us. Still we continued, but a clothes buying stop was necessary once the temperatures reached the 50s. Armed with new coats and sweatshirts we were on the road again. Breawna purchased a sweatshirt with butterflies adorning the front to symbolize the freedom for Tony that she was fighting for. Butterflies also were prevalent on her Tony t-shirt for the same reason.

Finally we arrive to the area and begin looking for the exit long anticipated for. The temperature was 39 degrees and a steady rain continued to be a nuisance. It was 3pm in the afternoon and we realized that we had taken longer than we wanted and that Breawna was already tired and offered to get a place to stay the night and return early the next morning. You can only imagine the conversation the followed as we were reminded that spending money in Louisiana was not allowed and that a wait overnight to visit Tony just would not do.

The exit we were seeking finally came into view and the child in the back seat could hardly sit still. Up on her knees she saw for the first time the cage that Tony calls his home. There was excitement as she sees Tony for the first time, which was quickly followed by silence. We park by the west side of his cage to prevent the employees in the snack shop from detecting us while we were filming. I looked into the backseat to see Breawna silently crying. Her face a witness to the heartbreak she was experiencing. Her voice laced with shock as she explains that she needed a few minutes to herself, can we go check the cage out. Knowing that she will finish what she came to do, we take the situation in as she gathers her thoughts. 15 or so minutes pass and I need to know that she is O.K. Dry eyed now she is ready to face the demons she came to conquer and the visit begins. She wanted to spend some time just observing him and talked to him in a soothing quite voice, telling him that she was there to help him. She asked him to stop pacing and come to stand by the cage because she wanted to start taping.

The rain and cold temperatures took its toll on her ability to speak consistently. In addition we noticed as did she that a man exited the snack shop and was standing not far from the cage watching while he smoked a cigarette. Her constant vigilance on him is evident in several shots. She never asked to quit and never faltered as I continued to worry that we would be discovered and asked to leave. Filming at his cage took 30 or more minutes and involved several takes of the different passages that she prepared. Due to her concerns and the situation we found ourselves in, we encouraged her to use her notes regardless of her pleadings that she had it under control. Taping had to be finished before we were discovered and I was worried about the attention we were receiving from his employees. We were then surprised by her request to go see if Michael Sandlin was able to talk to her. She insisted even after we spoke to her about the risk while getting warm in the car. So we find ourselves in the snack shop being told that he was not around and would not be that evening. We noticed a t-shirt with a beautiful tiger and stopped to check it out. That shirt ended up being the t-shirt designed to make fun of animal activists. Breawna was absorbing the meaning of the shirt when a truck driver enlightens her to what it meant. The same man who had watched us film at the cage continued to watch us in the store. With a disgusted look at him, she flicks her hair and states that she is ready to go to see the stuffed cat over the salad bar. With no disrespect intended, I believe she had just enough of the shirt and the situation and she was angered that she was denied a chance to speak to Sandlin.

We had learned that a white tiger was displayed over a salad bar in the restaurant, and in her unbelieving mind she could not imagine that it was true. Upon entry to the restaurant she saw Selena and noticed how filthy the place was. She mentioned how disgusting it was and that they even put fake eyes in her, but she could tell how beautiful she had been. As we are waiting at the counter by the door because another attempt to talk to Sandlin was requested she noticed a CD with his picture. As we read that it was Christian music something snaps in that 10 year old and she can’t fathom how he could be a Christian and cage a big cat like that. It’s time to leave; she is done with waiting because no-one has acknowledged us anyway. How do I answer the questions about how could a person who believes in God keep a big cat as a pet in a cage.

We continue to walk around to see what Tony has to look at each day and discover oil and gas on the pavement, she mentioned that she wants to stand there and hear and smell what it’s like to live here and after a few minutes wants to go say good-by. That’s when we discover that he is still pacing and that the cold has settled in. It’s getting dark and the cars are still lining up despite the cold and rain. Other children are viewing the tiger and my child stands lonely at the chain link with the fallen look of failure on her face, she really thought that she would be able to talk to Michael and change his mind. The day has taken its toll on her body but more on her spirit and she bids good night and good by to Tony, promising him that she will not stop, will not give-up till he is free.

We leave around 4:30pm that cold, rainy November day with a much more mature child, one that fell silent as soon as we hit the highway and we drive home in silence. Even stopping later to eat we could not encourage her to share her thoughts. We arrive home early in the morning and carry her to bed. The following day I expected to be actively questioned and was surprised at the depressed child I was faced with. She wanted to hide and stayed in bed all day. She needed time to absorb all the ugliness and face the demons that haunted her. What haunts me the most about the whole trip was the profound silence that followed us home that day.

I am pleased when on Sunday she comes back to the world with more resolve to help not only Tony but all big cats in the same situation. If only more people could see through the eyes of a child and resolve to change things because they know no other way but the way they want it to be.

There comes a time as a parent that you must make a choice to allow your child to discover that bad does exist and to grow from their experiences. I would not change a thing and have been questioned on why I allowed her to do what she did. But these people don’t live with a persistent child that relentlessly pursues what she believes in. I don’t want to limit her experiences just because they are not convenient and pleasant. Even while protecting her I have to let her go to help her to grow into what she’ll one day become. Her experiences with Tony’s freedom have given her confidence in what she does; can and will make a difference. She sums it all up in a story she wrote about her experience in that it may not end the way you expect, but doing something for a good reason is better that doing nothing at all.

Would I do it again? You bet…there is no way to stop this charging spitfire once she sees injustice toward animals especially big cats, so I expect our future will be filled with journeys and adventures in helping these cats she so loves.

I found out about Tony one weekend, well really I had already known about Tony from the Big Cat Rescue website for a long time, but one night I dreamed about him and started to really get worried about him. I checked for information and the more I found out the more I wanted to try to help him to feel better and let him know that I loved him. Tony is a 10 year old Siberian Tiger that has to live in a cage at a truck stop in Louisiana. So I started to ask my parents about plans for our family Thanksgiving trip. Every year we try to go somewhere and we had planned to visit my favorite place, Big Cat Rescue. All of a sudden it felt more important to go to see Tony.

Once my parents agreed to take me the day after Thanksgiving, I started to think like Tony and imagine how he was feeling and what he was going through. I wanted to talk to his owner. I started to write down things that were making Tony sad, so that I could have something to talk to him about. I let Big Cat Rescue know that I would go see Tony and would take some video to say what Tony was feeling and to be his voice.

We started really early in the morning and drove for hours. Each mile got us closer, but I was getting scared and my tummy had butterflies. I wanted to do this for Tony but was scared that his owner would get mad and hurt me or my parents or even Tony. Also it was raining and getting really cold and I was worried that Tony would get sick or that he would not be able to move around. We stopped for food and more clothes and I got a sweatshirt with butterflies on it for Tony. I wanted to look cheerful when he saw me.

Finally we were close and after 10 hours on the road, I thought that we would never get there. It was 3 O’clock in the afternoon and about 38 degrees outside with the rain still falling when we got off the highway. I saw the cage and it looked like a wire pen that was all tore up and dirty. When I saw Tony I felt sad and angry. I knew he would be in the cage, I just didn’t know that he would look so sad. It took me a while to even come out of the car; I just sat there and stared. I didn’t want Tony to think that I was angry at him, so I needed to calm down. Then I realized that the only way to help Tony and to be his voice was to get out there and greet him, talk to him and then to make my videos.

It was cold and raining, and I kept forgetting what I wanted to say, the cold wind was blowing and I kept looking at Tony and around us to make sure the people who worked there were not watching me. I was scared that they would make us go away. Then my mom said that I should just use the notes and things that I wrote down. I thought I didn’t need them, but it did help me to remember what I wanted to say.

Tony paced the whole time we were there and I kept getting cold, so we sat in the car a lot between filming to warm up. I was there for an hour and Tony kept on pacing in his cage going from one end to the other. He had a small grass area but it looked like he used it for the bathroom instead of a place to roll and lay around in. He had a pool with some wooden steps and then it hit me that a tiger that was playful and happy would have messed up those steps a long time ago. I noticed a broomstick inside his cage too but he had not chewed or played with it.

After I filmed I wanted to talk to Michael the owner and went to the snack shop where the gas pumps were. I asked to talk to Michael but the lady said he was not there. I saw a t-shirt that said that Animal Activist tasted like chicken. I did not like that shirt but it did have a pretty tiger on the front. Then I went to the place where they sell food to the truck drivers to see the stuffed tiger they keep over the salad bar. It was horrible to see such a beautiful tiger that did not even get the respect she deserved and now she sits where dust is on her and its dark and yucky in there.

I am glad that I made the trip and most people would agree with me that Tony is not happy and should not be there. I did learn that sometimes the journey we take may not always end that way we want it to, but doing something for a good reason is better than doing nothing at all. Making that trip helped me to realize that there are a lot more Tonys out there that need my help and a lot more people that need to be reminded that we should not keep something just because we like it. Keeping a Big Cat may be O.K. with the law but that doesn’t make it the right thing to do.

Tony’s Tribute by Breawna Smith:

· Tony’s journey in life didn’t start the way it should have.

· Tony was born 11 years ago and like many big cats he was hand raised for human entertainment.

· While he was young he was put into a cage and held against his wild instincts.

· His only crime was being born a beautiful tiger.

· He grew up in that cage and watched as his brothers and sisters were taken away.

· He waited for their return hoping everyday to be with them again.

· His sleep is interrupted by noise and bad smells fill the air around him.

· Sometimes he doesn’t even feel like greeting the people who come to stare at him.

· Michael although you have to give up Tony months from now, please do the right thing, before it is too late.

· A new life waits for him, this cannot be the end of the road for Tony, let it only be the beginning.

· (Here, Breawna dedicated a song by Rascal Flats to everyone who has fought for Tony)This song is dedicated to Sky(Williamson), BCR(Big Cat Rescue), the Animal Legal Defense Fund and all of Tony’s everyday Heros who fight for Tony’s freedom.

We fight this fight not only for Tony but for all big cats that are owned by people, because they can never truly be wild and free.

On August 29th, 2011, a Baton Rouge appeals court “tossed out” a prior judge’s ruling that barred state officials from issuing any new permits for Sandlin to keep Tony at the truck stop on side-show display.

What this means is that Sandlin’s “case” will be heard, and although the laws in Louisiana are clearly against Sandlin, this does not necessarily indicate that political corruption can not undermine justice.

Animal Legal Defense Fund attorney Matthew Liebman called the 1st Circuit ruling “a minor setback.”

“We are confident that the trial court got the law right the first time around and will rule the same way when we go through it again with Mr. Sandlin and the Tiger Truck Stop as parties,” he said.

Our suggestion to everyone is that we keep our ears to the ground and continue to support the ALDF case against issuing any new permits to Sandlin and his truck stop. Breawna continues to network, raising support for Tony and she plans to visit him again before December, in hopes of keeping the issue fresh in everyone’s mind.

Ruling in Tiger Truck Stop case tossed

BATON ROUGE, La. (AP) — A Baton Rouge appeals court has threw out a judge’s ruling that barred state officials from issuing any new permits to an Iberville Parish truck stop to keep a 550-pound tiger on display.
On Monday, a three-judge panel of the state’s 1st Circuit Court of Appeal sent the matter back to state District Judge Mike Caldwell for another hearing. The Advocate reports (http://bit.ly/mSOKZT ) the court ruled that Tiger Truck Stop Inc. in Grosse Tete and its owner, Michael Sandlin, deserve to be heard.
Caldwell’s ruling in May came after the Animal Legal Defense Fund sued the state Department of Wildlife and Fisheries to have Tony, a Siberian-Bengal mix, removed from the Interstate 10 truck stop.
Only attorneys for the animal rights group and the state agency took part in the first hearing.
Caldwell later denied Sandlin’s and Tiger Truck Stop’s request for a new trial.
First Circuit Judges Edward “Jimmy” Gaidry, Michael McDonald and Jeff Hughes said Sandlin and the truck stop “were parties needed for just adjudication in this case.”
The appellate court reversed Caldwell’s denial of the new trial request, vacated his May ruling in favor of the Animal Legal Defense Fund and sent the matter back to him “for further proceedings.”

Just when I loose faith in our youth today, along comes an 11 year old young lady with a passion for large cats. Well, all my loyal listeners know that the way to my heart is through cats of all shapes, sizes, and breeds. This one young person has made it her mission to save Tony The Tiger who has been locked in a cement and iron prison, alone, for over 10 years at a truck stop while putting up with being alone, teased, harrassed, loud sounds at all hours of the day and night and inhaling toxic fumes.
Join me as I talk to this little package of huge inspiration and we will hear all about what she has done to help Tony become free. Now we have won one battle. The owner of the truck stop was denied a renewal license to keep Tony but his current license doesn’t end until the end of December. Poor Tony needed to be set free 10 years ago!
