Back on November 3rd, the article was published about the huge victory for Tony the Truck Stop Tiger.  The Animal Legal Defense Fund (ADLF) in concert with advocates for Tony had succeeded in getting a court decision that the permit to keep Tony imprisoned was unlawfully issued and would be revoked, with no new permits ever being issued.  You can read that story here.

Sadly, the good news has been short-lived.  On November 30th, Tony’s guardian and owner of the Tiger Truck Stop, Michael Sandlin, has filed an appeal of the decision.  Also, the Louisiana Department of Wildlife and Fisheries filed papers regarding the decision that stated they were responsible for the costs.

All of this legal wrangling means that Tony stays right where he is.  This is even in the face of the fact that the current permit expires this month, regardless of the court decision.

Tony is an 11-year-old Siberian-Bengal tiger who has been used as nothing more than an attraction at the truck stop, living in an enclosure where he is taunted by tourists and breathes the gas and diesel fumes constantly.  The fight to free Tony has gone on for years, with roadblocks being thrown up at every turn trying to keep him in this prison.  You can read Tony’s story in detail at the Free Tony the Tiger website linked below.

The youngest advocate in Tony’s campaign, 11-year-old Breawna Smith, visited Tony on November 19th and took several videos.  The video provided here courtesy of Ms. Smith is one she had created called “Tony’s Journey” and includes her narration of a poem she wrote for him.  It’s heartbreaking to see this magnificent animal reduced to this existence. You can visit her YouTube site at the link below to view all of the videos she’s taken of Tony.

Who knows how long this latest round of legal maneuvers will take, all the while as Tony waits. Even though Judge R. Michael Caldwell agreed that the permit should be revoked, which would have set Tony free, Sandlin simply won’t allow Tony to have that peaceful life.  He wants his “main attraction” to stay, bringing in the customers and of course, the income.

It appears that Tony is caught in the middle of a tug-of-war between what’s right and just, and pure and simple greed.  This magnificent animal is wasting away right before our very eyes, while the slow wheels of bureaucracy grind on.

The petition at Care2 is linked below.  While advocates believed their voices had been heard and Tony was finally to be free, such is not the case and your voices are still needed for Tony.  Please consider adding your voice to this petition for Tony.  (The petitions at Care2 normally allow for anyone from any country to sign.)

Advocates in Tony’s campaign have vowed to never give up.  As his staunchest supporter and Founder of the Free Tony the Tiger campaign, Sky Williamson’s motto says: “Until His Last Breath…” That one statement says it all.

Don’t give up Tony.  Advocates everywhere are fighting for you to finally know the peaceful life you so deserve.

ALDF Files Suit to Free Tony the Truck Stop Tiger

TonyUpdate
November 2, 2011:
Great news from Baton Rouge, where Judge Michael Caldwell has ruled in favor of the Animal Legal Defense Fund and Louisiana taxpayers in our lawsuit to free Tony the Tiger from the Tiger Truck Stop in Grosse Tete, Louisiana. Read more…

September 20, 2011:
The court has scheduled two new hearings in the Tony the Tiger case. On October 17th, the court will hear the State’s exceptions, which challenge the plaintiffs’ standing to bring the case. On November 2nd, the court will hear ALDF’s motion for a permanent injunction to revoke the permit that lets Michael Sandlin confine Tony at the Tiger Truck Stop.

August 29, 2011:
This morning, the Louisiana Court of Appeals ruled that Michael Sandlin and the Tiger Truck Stop are necessary parties to the Animal Legal Defense Fund’s lawsuit to free Tony the tiger and ordered a new trial in the case. In so ruling, the Court vacated the permanent injunction issued by the trial court that would have freed Tony in December. The decision means ALDF will need to amend its complaint to add the new defendants, then re-do the litigation thus far. While we disagree with the Court of Appeals’ ruling, this is just a minor set-back. We are confident that the trial court got the law right the first time around and will rule the same way when we go through it again with Mr. Sandlin and the Tiger Truck Stop as parties.

August 15, 2011: ALDF lawyers were in court today to defend against Sandlin’s attempt to get our case dismissed. In another victory for Tony, the judge denied Sandlin’s motion. This means the case will continue to move forward. The Court has set a hearing date of September 15 for ALDF’s motion for a mandatory injunction, which seeks an immediate revocation of Sandlin’s permit to keep Tony.

July 19, 2011: The Animal Legal Defense Fund filed a motion for a mandatory injunction in June that would compel the Louisiana Department of Wildlife and Fisheries to revoke the current permit and seize Tony—meaning that Tony would not have to wait until December to experience his new life beyond the Tiger Truck Stop. Although this specific request was part of ALDF’s original complaint, the court did not rule on it at the hearing in May. A new hearing on the motion for a mandatory injunction was set for July 22, but has been postponed to a later date yet to be determined.
May 6, 2011: Victory for Tony! This morning, a judge in East Baton Rouge District Court granted the Animal Legal Defense Fund’s request for a permanent injunction against the Louisiana Department of Wildlife and Fisheries, preventing the Department from renewing the annual permit that allows Michael Sandlin, owner of Grosse Tete’s Tiger Truck Stop, to display Tony. When the current permit expires in December 2011, Sandlin will no longer be able to keep Tony confined as a roadside exhibit at the truck stop where he has languished for over a decade. Read more…

The stench of fuel. The deafening sound of diesel engines. The neverending boredom of captivity and isolation. Such are the conditions in which Tony, a 10-year-old Siberian-Bengal tiger, has spent every day and night of the last decade at the Tiger Truck Stop in Grosse Tete, Louisiana. It’s no life for a tiger, or any other animal. That’s why the Animal Legal Defense Fund has filed a lawsuit in Louisiana, arguing that the permit that allows Tony to languish in a roadside cage violates state law.

Kristin Bauer, the actress who portrays the lovely-but-lethal vampire Pam on HBO’s award-winning True Blood, has teamed with the Animal Legal Defense Fund in the fight to free Tony.

Tony’s Tragedy
In addition to being subjected to noise and diesel fumes 24-hours a day, Tony is also frequently harassed and taunted by visitors at the truck stop. His enclosure is devoid of adequate enrichment, such as logs, trees, or complex vegetation that would allow him to engage in natural tiger behaviors. He has no pool of water large enough to allow him to submerge himself to cool off in the blazing heat of the summer. As a result of the stress of his confinement, Tony constantly paces on the hard concrete surface of his enclosure, putting him at risk for dangerous and painful veterinary conditions. Michael Sandlin, the owner of Tony and the truck stop, has been cited by the USDA due to violations of the Animal Welfare Act, including a lack of proper sanitation and improper feeding practices.

Year after year of living at the Tiger Truck Stop have taken their toll on Tony’s health. The ambient noise from the nearby freeway and the idling trucks, their diesel engines spewing noxious fumes directly into his enclosure, is painful and obtrusive to an animal with such sensitive hearing and an acute sense of smell, says veterinarian Jennifer Conrad, who has 16 years of experience with captive large cats and has visited Tony. “Based on what I have observed of Tony’s enclosure at the Tiger Truck Stop and his behavior from video and photographs, it is my professional opinion that this tiger is in poor condition and needs intervention on his behalf,” she says.

ALDF’s Argument
On April 11, 2011, ALDF filed a lawsuit against the Louisiana Department of Wildlife and Fisheries (LDWF) and its secretary Robert Barham, arguing that he violated state law in granting a permit allowing Sandlin to exhibit Tony at the Tiger Truck Stop. Joining ALDF as a co-plaintiff in the case is former Louisiana Representative Warren Triche, who authored the state’s law which led to the ban on the private ownership of tigers. Two other Louisiana residents, also deeply concerned by Tony’s long-time suffering, are additional co-plaintiffs.

At the heart of ALDF’s position is the fact that Sandlin’s current housing of Tony violates state and local laws. In 2006, the Louisiana state legislature unanimously passed Act 715, which required LDWF to control the private ownership of big cats. The department enacted regulations prohibiting citizens from keeping a tiger as a pet or exhibiting a tiger in the state. In passing these regulations, the department rightly declared that possession of big cats and certain other exotic animals poses significant hazards to public safety and health and is detrimental to the welfare of the animals.

The regulations provided an exception, however: individuals who legally owned big cats as of August 15, 2006, were grandfathered in. These owners would need to apply for an annual permit from the LDWF. An ordinance passed in Sandlin’s parish of Iberville in 1993 made it illegal for anyone to keep a tiger or other large exotic cat on his or her premises for exhibition. In other words, Sandlin did not qualify for the exception because he was not in legal possession of Tony. In addition, Sandlin is ineligible for the state’s grandfathering provision because he does not live on the premises where Tony is kept, contrary to regulations.

Despite the fact that Sandlin was ineligible for a grandfather permit, the LDWF nonetheless issued him one. ALDF is taking the department to court to invalidate this illegally-issued permit.—and free Tony from his troubled life at the truck stop.

Owner: Every American Should
Have The Right To Own Exotic Animals

The debate over whether a tiger
can remain as an attraction at a Grosse Tete truck stop has been clawed at for
years. A state judge ruled that the Tiger Truck Stop owner could no longer keep
his tiger, Tony, at the gas station. Michael Sandlin, Tony’s owner, said
thousands have come to marvel at the exotic animal on display at the truck stop.
“We’re from Florida and we were on our way to Texas and it was kind of amazing
to see a big cat here,” said Jody McGahan, a Tiger Truck Stop customer. “He’s
beautiful” “Every American should have the right to own an exotic animal of
their choice if they’re financially and morally capable of taking care of that
animal,” Sandlin said. The Department of Wildlife and Fisheries gave Sandlin a
permit to keep the tiger, but a nonprofit group, the Animal Legal Defense Fund
filed a lawsuit against the agency in a bid to have the cat moved to a more
natural setting.

“They want to yank him
from the only home he’s known for the past 10 years and the people that he’s
known and send him to another cage somewhere where he won’t have that,” Sandlin
said.

The paddock the animal is kept in appears larger than some zoo
exhibits with a grassy area, a tank for the tiger to swim in, toys, shade and an
air conditioned room for Tony. The barred cage is surrounded by a barbed-wire
fence and the truck stop is staffed 24 hours, Sandlin said. Regardless, a judge
will have to decide if the attraction will be allowed to stay. “He’s beautiful.
I would miss him,” McGahan said. Sandlin hasn’t filed an appeal yet, but his
attorney said he plans to do so. The Animal Legal Defense Fund said it will
“continue to do everything we can to make sure Tony’s next home is a reputable,
accredited sanctuary that can give Tony the life he deserves.”

For Legal Reasons this was not going to be posted until after the trial but since 2 pages have already posted it- I guess there is NO reason not to share it now. Think about it – why would Sandlin get a physical for Tony right before court? Use your common sense…..

DO NOTICE HOW SHANNON THE VET DARTS TONY ON TOP OF THE
CONCRETE DEN THEREFORE HE CAN FALL OFF AND BREAK HIS NECK. WOULD IT HAVE BEEN
SO HARD TO THROW A PIECE OF MEAT DOWN ON THE FLOOR SO HE WAS NOT IN DANGER OF
FALLING????? SO IN REALITY THE MOST DANGEROUS PART OF SEDATING TONY WAS THAT
THE VET DID IT IN A PLACE WHERE HE COULD HAVE FELL AND BROKE
BONES!!!!!!!!!!!!!!!

RIGHT FROM THE START THE LIES BEGIN- TONY HAS ONLY HAD A VET SINCE 2008. HE NEVER HAD ONE BEFORE. 2.) AFTER ALL THE FIGHTING ABOUT SEDATION LOOK WHAT THEY DID. ★★★MESSAGE FOR JOE EXOTIC-MR. EXPERT★★★ LOOK JOE EXOTIC ONCE AGAIN YOU MADE AN A** OUT OF YOURSELF AND YOUR WORDS ARE BITING YOU IN THE A**

EXCUSE ME! YOU DO NOT “CLEAN” TEETH WITH PLIERS- YOU PULL TEETH WITH THEM. YOU GUYS REALLY THINK WE ARE A BUNCH OF REALLY DUMB PEOPLE………
THE VIDEO SAYS TONY PASSES WITH FLYING COLORS……… HOW COULD YOU POSSIBLY KNOW THAT WITHOUT GETTING THE TEST RESULTS BACK??????

THIS IS WHAT JAMES PLATT POSTED: “that is one awful song! too bad you had to have this done, but it proves you were right and Tony is okay”.

THIS IS THE SAME IDIOT THAT CLAIMS THAT HE DID SO MUCH TO HELP TONY TO FREEDOM!!!!!!

Truck Stop Tiger

In December 2010, the state of Louisiana renewed an owner’s permit allowing a caged tiger to be kept in a truck stop parking lot. In April 2011, the Animal Legal Defense Fund filed a lawsuit to have the permit removed as it violates state and local ordinances put in place to protect both people and wild animals from these types of situations. Let us break this issue down into a rudimentary point, counterpoint perspective, and see if clarity of common sense will emerge.

The Merits of Marketing:

Point:
The Tiger Truck Stop has built their business of filling truckers’ tanks and bellies around a caged tiger kept in their parking lot. Their sales pitch, as stated on their website, “ANYBODY can go to Louisiana and see an alligator! You can tell your friends you saw a TIGER!”

Counterpoint:
America is a big place. Alligators are only found in the southeastern parts of the country. The chances are tourists who are interested in animal exploration in Louisiana, are actually looking for gators and not a lone tiger.

The thrill of going out on a swamp boat; wind whipping through your hair as you bounce up and down in your seat; eyes stealing for a glimpse of nature’s murky predator. Suddenly, you happen across a wild alligator and fumble to get an in-focus picture of a flailing tail and snapping jaw. This heart pounding experience is exclusive to a select few states in America, Louisiana being one. Whereas, you can go to any zoo anywhere in America and see a caged tiger, sitting, pacing, and yawning, it is anticlimactic by comparison.

What is most perplexing about their sales pitch is that it is not even remotely aimed at their target audience – truckers. If this truck stop put up a sales campaign for longer showers at a lower cost or free polish with every truck wash they would fill the gas pumps, store, and restaurant toot sweet. Truckers would be passing the information along like a hot ticket item to any trucker heading toward the area. It is how that particular marketing network works.

Seeing a tiger has nothing to do with helping out a trucker’s bottom line. Therefore, there is no reason to pass along the truck stop information. Turning this entire scheme into ineffective costly marketing that leaves the owners pleading for donations and pining for negative media attention to capture the sympathy dollar.

The rights of a concerned community and nation:

Point:
The truck stop claims animal rights activists are harassing them. Further stating, they have the right to private ownership of wild animals.

Counterpoint:
You are a truck stop and are therefore a public domain with public responsibilities.

Humanitarian responsibilities:

Point:
The truck stop has started a petition to keep the tiger at the truck stop. Those supporting the petition did so mainly out of concern for the tiger and not the permit holders. They point out that the tiger has been held captive his entire life. Therefore, it would be cruel to subject him to having to adapt to a life out in the wild.

Counterpoint:
It is unfortunate that the permit holders have permanently altered this tiger’s existence. However, nobody is saying drop the animal into the wild. There are a multitude of conservation programs prepared to offer him a more natural way of life in an environment better suited to him. Rather than a life confined to a small, barren, cage. The permit holders are aware of the options.

What is being said is free the animal from his indentured servitude. Release him to one of the conservation parks where he will have a life free from gawking, taunting, having items thrown at him, never-ending petrol fumes and noise, and no space. That should be wanted for any truly loved “family pet.”

This is where a constituency looks to its government for clarity of direction and leadership. It behooves Louisiana to enforce animal and social welfare mandates, particularly in the wake of 600,000 dead animals from the Katrina fallout. Farm animals reared for slaughter have the benefit of stricter governmental guidelines for quality of life than this endangered beauty. The Federal Endangered Species Act and the Federal Lacey Act protects endangered animals from any activity that may be detrimental to the species, whether its origin is foreign or domestic. The fact that tigers are not indigenous to America should not hinder this animal from receiving those protections.

Man’s attempt to domesticate the big cat will not put an end to their endangerment; only hasten their extinction.

For those interested in compelling the state of Louisiana to retract this permit, sign the Animal Legal Defense Fund’s Petition.

More trouble for Tony the Tiger

Posted by Alex Woodward on Tue, Aug 30, 2011 at 10:20 AM

Back in May, the Animal Defense Fund slapped a big ol’ lawsuit against the Louisiana Department of Wildlife and Fisheries to remove Tony the Tiger from an I-10 truckstop roadside attraction.
Judge Michael Caldwell denied truck stop owner Michael Sandlin’s request for a new trial. His ruling denied state agencies from issuing new permits to keep the big cat, a 550-pound Bengal-Siberian. But now, the state’s 1st Circuit Court of Appeal sent the file back to Caldwell, saying the owner deserves another hearing.
Does he? Read more about Tony and Sandlin in Gambit — about violations at the truck stop, like “failure to properly clean cages to maintain adequate sanitation, failure to maintain structurally sound cages, not utilizing a sufficient number of adequately trained employees, improper food storage, failure to provide sufficient food, unsanitary feeding practices, failure to have a veterinary care program, mishandling animals, failure to clean water receptacles with algae growth and failure to provide shelter from inclement weather.” Sandlin has been named a Top 10 offender by PETA, and violator of the USDA’S Animal Welfare Act. Here’s the April ALDF campaign video for Tony, with True Blood‘s Kristin Bauer:

Following the appeal, Sandlin’s attorney Steve LeBlanc told the Adovcate, “We’re very pleased. This will give us a chance to correct the situation.” In a statement following the ruling, ALDF attorney Matthew Liebman called it “a minor setback” and is “confident that the trial court got the law right the first time around and will rule the same way when we go through it again.”
On the Tiger Truck Stop website, a petition reads: “Is Tony in need of being rescued? No, he is in good health, has a nice compound, and is very loved by his owner. … The rights we all have as Americans are being torn away from us daily by the Animal Rights Groups. What does an organization on the west coast really care about a tiger in Louisiana anyway, other than to make headlines and put another notch in their gun?”
